Article 2 – Scope and Applicability

The following Terms and Conditions apply to all visitors or users of the site. By using this site, you agree to be bound by these terms and conditions, as they may be modified by us at any time and posted on this website. In case of contradiction or silence from this terms and conditions the Belgian law will be applicable.

In case one of the conditions in this terms and conditions would be illegal or invalid, the other conditions remain applicable.

The Terms and Conditions which are applicable on the order are the terms and conditions which were published at the time that the order was made. They will annul all earlier or later terms and conditions. The customer is able to download and print these general Terms and Conditions.

As referred to in these site rules, “STARE” refers to STARE VOF.

The present General Terms and Conditions govern the rights and obligations of the parties arising out of the online sales of products offered on sites belonging to STARE. STARE provides all its services from Belgium and The Netherlands. The contract between the parties will be deemed to be performed in Belgium, dispatching to different countries from Belgium.

These General Terms and Conditions apply to all products sold via the site. They may not be varied without STARE’s express prior consent in writing.

The Terms and Conditions are written in english. In case the content is unclear there is always the possibility to go to the contact form and ask your questions.

Article 3 – Capacity in law and Acceptance 

Anyone wishing to buy products from STARE must have capacity to act in law. Should anyone be declared without capacity, they may not buy any products on STARE’s site and so acquire the capacity of customers. They must then purchase via their lawful representatives. These lawful representatives will be bound by the Terms and Conditions.

The customer accepts these General Terms and Conditions expressly by clicking on a tick or putting a cross against the words “I agree with the Terms & Conditions”. The order can under no circumstances be definitive without acceptance of these Terms and Conditions, the price and the descriptions of the product(s).

The supplier can refuse every order if there is a serious assumption of abuse, abuse of law or bad faith.

Article 4 – Annulation

STARE cannot be held liable for products not being available. Should one or more products in an order not be available, STARE will inform the customer via email or in writing that it has cancelled his or her order wholly or in part or split it.

Should products be found to be unavailable and the customer is informed of this but they have already paid for their products, STARE will ask his or her bank information to refund the amount paid for the products in question immediately, informing the customer by email accordingly. How fast the refund is actually made depends on how the customer chose to pay when making their purchase. Should the customer find the refund is taking an abnormal length of time, they are advised to contact their bank.

STARE will also cancel the order if the address details are unclear, incorrect or insufficient to send the products, STARE will inform the customer via email or in writing that it has cancelled his or her order. If the customer has already paid for their products, STARE will ask his or her bank information to refund the amount paid for the products in question immediately.

Customers can cancel their order, only if it hasn’t been processed yet. They can do so by contacting us. STARE will cancel the order and will ask its bank to refund the amount paid for the products in question immediately, informing the customer by email accordingly. How fast the refund is actually made depends on how the customer chose to pay when making their purchase. Should the customer find the refund is taking an abnormal length of time, they are advised to contact their bank.

Article 5 – Prices and Invoicing

Prices are those as shown on sites at the moment the customer places their order. Prices stated during the purchasing process are expressed in euros and include VAT and administrative costs unless expressly stated otherwise.

Product and service prices do not include transport costs: these will be charged separately, and the customer must pay them in addition to the purchase price. Any discount the customer is allowed will be deducted from the price of the products, not from the transport costs.

STARE reserves the right to vary selling prices and transport costs at any time, although the products purchased and costs will always be invoiced as stated in the email which confirms the order. These are the prices that apply at the time of purchase, provided the products were available.

The customer agrees to STARE sending its invoices electronically.

Products will remain STARE’s property until such time as the customer pays for them in full, i.e. until they pay the purchase price and costs in full.

Article 6 – Payment methods

Purchases can only be paid for online, by VISA, Mastercard, American Express, Maestro, Bancontact/Mister cash, Paypal, Apple pay, Shopify Pay and via Direct Banking (ideal for The Netherlands). The customer’s bank account will be debited once the purchase has been confirmed, and payment will not take effect until such time as the customer’s bank has given its consent to STARE. Should the customer’s bank refuse payment, the order will be refused automatically.

The customer warrants they are authorized to make payments by one of the payment methods as stated above, and that there are sufficient funds in the bank account linked to the credit card to cover all the costs arising out of the transaction, failing which STARE may refuse the order.

STARE uses Mollie and Paypal to handle payments online. STARE has no access to its customers’ confidential payment details, nor does it keep them.

STARE reserves the right to refuse any order from a customer with whom it is in dispute or who has brought a dispute in the past. STARE may also refuse an order should the customer not have paid for a previous order, wholly or in part, where there is a serious assumption of abuse, abuse of law or bad faith.

Article 7 – Ordering Products

Products offered by STARE are those displayed on the site at the time the customer places their order, subject to availability.

All orders must be placed through the site. STARE will make every reasonable effort to deliver all orders as quickly as possible.

All products listed are described and displayed with care and accuracy; however, images on the site are not legally binding. STARE cannot be held liable for minor differences in color, sizing, or appearance between product images and the delivered item.

Regardless of any written communication, both parties expressly agree that data recorded in STARE’s IT systems, and those of its hosting and payment providers, will serve as conclusive evidence of communications, order contents, and transactions made between the customer and STARE.

To place an order, the customer selects the desired product and size, then clicks “Pre-order” or “add to shopping bag.” The item will then appear in the shopping bag, which can be edited at any point before payment. To finalize the order, the customer selects a delivery and payment method. The total price is clearly displayed during the checkout process.

Once payment has been completed, the order is considered final, except if the customer contacts STARE in time to change it and the request is accepted before shipment.

Customers will receive a confirmation email after placing the order, and a second email when the order has been dispatched.

Article 8 – Deliveries

During checkout, customers may choose delivery to any address of their choice (home, office, etc.).

STARE will aim to dispatch products according to the shipping schedule provided on each product page. These timeframes can vary depending on product type and sales strategy. The estimated shipping date is included in the order confirmation email.

Products will be shipped to the delivery address provided by the customer. STARE reserves the right to split an order into multiple shipments depending on product availability. Each shipment will be confirmed via email.

Each delivery will include a packing slip with a description of the delivered goods.

If a delivery is lost in transit, and all required delivery procedures have been followed, STARE will resend the order free of charge if stock is available or refund the order in full, including shipping costs. The risk of loss or damage transfers to the customer upon delivery.

Article 9 – Right to Revoke & Returns/Exchanges

The customer has the right to revoke their purchase within 14 calendar days of receiving the products, without giving a reason or incurring a penalty.

To revoke a purchase, customers must submit a return request via the contact form (email), providing the order number, order date, shipping address, product names (including size and color), and quantity.

Returns must be shipped within 14 calendar days of the revocation notice. Items must be returned in new condition: unworn, unwashed, in original packaging, and with the original sales invoice and completed return form. Returns that are unidentifiable will be refused.

Returns and exchanges must be initiated via the Returns & Exchanges platform on our website. Costs and shipping risks for the return are the responsibility of the customer and vary depending on the country of return.

STARE will issue a refund once the product is received or proof of return is provided. Refunds will include the purchase price and original shipping fee, never exceeding the total paid.

Refund methods:

  • Credit card: Refunded to the same card, minus any discounts used.
  • Other payment methods: Refunded to the bank account stated on the return form.
  • Gift cards: Refunded as a renewed gift card; any remaining amount will be refunded to the provided bank account.
  • Vouchers/discounts: Cannot be refunded in cash.
Article 10 – Statutory Warranty & Complaints Procedure

STARE warrants that all products sold on the site conform to the description and are free from defects in material and workmanship at the time of delivery. This warranty does not affect the legal warranty rights granted under Belgian consumer law or any other mandatory national legislation applicable to the customer.

Under this statutory warranty, customers are protected against any non-conformity existing at the time of delivery, which becomes apparent within 6 months of the product’s receipt. The warranty period is paused while the product is being repaired or replaced or when settlement discussions are taking place.

To invoke the warranty, the customer must:

  • Notify STARE in writing (via email or the contact form) of the defect within two months of discovering it.
  • Include order details, description of the defect, and supporting photos where possible.

STARE will then:

  • Assess whether the defect falls under the warranty conditions.
  • Offer an appropriate remedy, which may include: repair, replacement, or refund of the item.

Exclusions to the warranty include:

  • Damage caused by improper use or care.
  • Wear and tear from normal use (e.g., fabric pilling, fading).
  • Damage due to neglect, intentional acts, or external causes (e.g., accidents, fire, water).

The statutory warranty only applies when the products were used as intended, stored properly, and washed according to care instructions. No compensation will be given for indirect or consequential damages.

Customers are encouraged to retain original packaging and proof of purchase to facilitate claims.

In case of complaints:

  • STARE aims to respond within 7 business days.
  • Disputes unresolved through customer service may be referred to the European Online Dispute Resolution (ODR) platform for mediation.

Commercial Restrictions:

STARE products are intended exclusively for personal, non-commercial use within the European Union. The resale, commercial distribution, or export of STARE goods outside the EU without written permission is prohibited.

STARE reserves the right to:

  • Suspend future sales to individuals violating this policy.
  • Charge verification or legal follow-up costs to the customer in cases of violation.
Article 11 – Intellectual Property Rights

All components of the website, including but not limited to texts, databases, images, videos, graphics, logos, music, and the layout and structure of the web pages, are protected by intellectual property rights, including but not limited to copyright, database rights, trademark rights, and design rights. These rights are owned either by STARE or by its licensors and are protected worldwide.

No content on the website may be reproduced, copied, distributed, transmitted, published, or used in any way, in whole or in part, without the express prior written permission of STARE. This applies to both commercial and non-commercial purposes. Any unauthorized use of the content of the site constitutes a violation of intellectual property laws and will be pursued before the competent courts.

STARE may provide tools for sharing specific content via social media platforms. In such cases, the right to share is limited exclusively to the features and platforms for which STARE has expressly enabled sharing. Customers may not otherwise download, edit, reuse, or republish any content.

Any infringement of STARE’s intellectual property rights, whether intentional or not, will result in legal action, including claims for damages and the recovery of all related legal costs.

Article 12 – Liability

STARE cannot be held liable for any direct or indirect damages resulting from access to or use of the site, including any viruses or malware that may infect the user’s computer equipment or software. Nor can STARE be held liable for any misuse or unauthorized use of its systems, including hacking or data theft.

STARE endeavors to describe its products as accurately as possible and to keep all information on the site up to date. However, typographical errors, inaccuracies, or omissions may occasionally occur. Product images are provided for illustrative purposes and may differ slightly in color or design from the delivered item. STARE does not accept liability for such discrepancies, nor for inaccuracies in product descriptions or prices.

STARE cannot be held responsible for the non-performance of an order due to stock shortages, delayed delivery from suppliers, or force majeure, including but not limited to strikes, fires, floods, natural disasters, pandemics, shipping disruptions, or governmental restrictions.

In all cases where STARE may be held liable, its liability shall be strictly limited to the total amount paid by the customer for the relevant order. STARE will not be responsible for any loss of income, business interruption, loss of data, or any other indirect or consequential damage arising from the use of the site or purchase of products.

If an error in the price of a product is identified after an order has been placed, STARE will inform the customer as soon as possible. The customer will then have the option to confirm the order at the correct price or cancel it. If the customer does not respond, or if STARE cannot reach them, the order will be cancelled, and any amounts paid will be refunded in full.

Article 13 – Disputes and Governing Law

As far as consumers are concerned, the statutory regulations will be followed, in all other cases the courts of the district of Antwerp will have jurisdiction or, if necessary, the Antwerp court of appeal.

The agreement between the parties is governed by Belgian law.

Article 14 – Varying General Terms and Conditions of Sale and Nullity

STARE reserves the right to modify or update these Terms and Conditions at any time without prior notice. Any such changes will take effect immediately upon publication on the website and will apply to all future transactions from that point onward. The version of the Terms and Conditions in effect at the time of placing an order will apply to that order.

STARE also reserves the right to change the design, layout, functionality, or content of its website at any time, including the availability of certain products, features, or information.

If a competent court declares any provision of these Terms and Conditions to be null, invalid, or unenforceable, this shall not affect the validity and enforceability of the remaining provisions. In such a case, the affected provision shall be interpreted in a way that comes as close as possible to the original intention of the parties.

Article 15 – Feedback

STARE welcomes all forms of feedback, questions, or comments from customers. Any feedback may be submitted via the contact form available on the website or by email to hello@stareantwerp.com.

STARE values customer insights and takes all suggestions into consideration as part of its ongoing efforts to improve its products and services. By submitting feedback, the customer agrees that STARE may use the information without any obligation to provide compensation or credit, unless agreed otherwise in writing.
